Terms of Service

Comercii Publisher. Effective 10 October 2026.

These Terms govern use of Comercii Publisher (the "Service"), available at social.comercii.io and operated by Comercii Inc. ("Comercii", "we", "us"). By using the Service you agree to these Terms and to our Privacy Policy.

1. Who may use the Service

The Service is invitation-only and is used to publish to the social accounts of brands that Comercii owns and of client brands it manages. You may use it only if Comercii has invited you and you are at least 18 years old. If you are using it on behalf of a business, you confirm you have authority to do so.

2. Accounts and connected social accounts

Keep your sign-in credentials confidential and tell us at [email protected] if you believe your account has been accessed without permission. You are responsible for activity under your account. Connect only social accounts you are authorised to manage. Connections are made through each platform's own consent screen and you can disconnect an account at any time.

3. Your content and platform rules

You are responsible for the content you upload, caption and publish, and for having the rights to use it. You must follow the terms and policies of each platform you publish to, including TikTok's Terms of Service and TikTok's Community Guidelines. TikTok requires users who post to confirm "By posting, you agree to TikTok's Music Usage Confirmation"; that is TikTok's requirement of users, and you are responsible for meeting it. The Service does not post anything without your action in the tool.

4. Acceptable use

You must not use the Service for unlawful, harmful, fraudulent or abusive purposes; to publish spam or content that infringes others' rights; to impersonate anyone; to upload malware; to probe or bypass security measures; or to violate any applicable law or any platform's rules.

5. Suspension

We may suspend or end your access at any time, with or without notice, if we reasonably believe you have violated these Terms or if continued access poses a risk to the Service or others.

6. No warranty

The Service is provided "as is" and "as available" without any warranty of uptime, continuous availability, or freedom from bugs or errors. Platforms may change or restrict their APIs, and we are not responsible for such changes.

7. Limitation of liability

To the maximum extent permitted by applicable law, Comercii and its directors, officers, employees, agents and licensors are not liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, revenue, data or goodwill, arising from your use of or inability to use the Service. Comercii's total liability for all claims relating to these Terms or the Service will not exceed CAD $100. Some jurisdictions do not allow certain limitations, in which case the limits apply to the fullest extent permitted by law.

8. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions. Any legal action relating to these Terms or the Service must be brought exclusively in the courts located in Ontario, Canada.

9. Changes

We may update these Terms from time to time. When we do, we will update the effective date on this page. Continued use of the Service after a change means you accept the updated Terms.
